Did you know that in Ohio the legal limit for drink is .08? Most probably do. BUT did you know that you can still be charged with an OVI? Even if you blow a .01...if the officer feels that you are imparied he can charge you with an O.V.I. so in other words if a cop needs to make qouta or just wants to be a jerk...he can charge you even though you were under the legal limit! And there are two tiers that you are charged by. If you blow over a .17 then it is a high tier and the fines and jail time are doubled. WHY is it this way you ask, because even though there is a .08 legal limit...Ohio has a NO TOLERENCE for alcohol. And if you take a medication that says "Do not operate heavy machinery" and then you go to the grocery store and get pulled over...yup you guesses it..you are charged with an OVI. When the law changed from DWI to OVI so did the meaning of the letter "I". It used to stand for "intocated" now it stands for "impaired". Just like to know how many people did or did not know some of the newer laws and how they feel?

The OVI is there to also catch the high school
and college going punks doing drugs, not just
alcohol.

So stop whining and have a drink...or a doobie.

The laws changed in 1990 as Truck drivers, school bus drivers, company trucks, city vechiles or any commercial vechile came under the CDL driver, and the drinking laws are changing every year as a CDL driver and this includes your own car at all times!! Accidents weather your fault or not you have 2 hours to get to a testing center or your in big trouble. for a 150lb man, 1 shot of whisky=1 6oz beer=1 6oz glass of wine, takes 1 hour to clear the blood stream, sweating does not help,nor going to the bathroom alot, wait 1 hour and of course the more you have you have to double up the time, call a cab!! I like living

I have a perfect driving record & I did not know of the LAW! But I also Dont Drink, or Do Drugs so I AM GLAD ABOUT THEM! The only prob. is the Idiots that still get behind the wheel after 10, 11 & 12 OVI'S!!! & then KILL SOMEONE! That should Be Premeditated MURDER!
When you get behind the Wheel & You have been Using I dont care what & you Kill someone!! You knew the Dangers of what could happen! Why wont anyone address that!!!

Wow I did not know that. Interesting.

Though I am curious how Ohio has a no tolerance policy against Drinking and Driving when we have so many repeat DUI offenders who kill people.

SOME MORE INTERESTING FACTS ON OHIO OVI/DUI LAWS:

BLOOD ALCOHOL LIMIT:

* .08% (by weight) for blood, or

* over .08 of 1 gram (by weight) per 200 liters of for breath, or

* .14 of a gram (by weight) per 100 milliliters of urine.

* For persons under 21 it is even less (e.g. .02% (by weight) for blood.)

One can be convicted be "under the influence" if a jury determines that:

"the defendant consumed some alcohol or drug of abuse, whether mild or potent, in such a quantity, whether small or great, that it adversely affected and appreciably impaired the defendant's actions, reactions, or mental processes under the circumstances then existing and deprived him of that clearness of intellect and control of himself which he would otherwise have possessed."


OHIO'S DRUNK DRIVING LAWS:
Ohio Department of Public Safety figures indicate 1,975 people were killed and 73,536 were injured in 102,271 alcohol-related crashes in Ohio from 1998 to 2002—an average of 395 deaths, 14,707 injuries and 20,454 crashes annually. Nationally, alcohol-related deaths have been increasing each year since 1999. In 2002, 41% of the 42,815 US motor vehicle fatalities were alcohol-related. This translates to 17,419 deaths, or an average of one alcohol-related fatality every 30 minutes in the US.

OHIO'S CHANGING OF DRUNK DRIVING LAWS:
On January 1, 2004 Ohio adopted a new OVI (Operating a Vehicle under the Influence) violation. It replaces violations for DUI (Driving Under the Influence) and OMVI (Operating a Motor Vehicle under the Influence).

The 2001 US Transportation Appropriations Act mandates that a portion of a state’s highway construction fund be WITHHELD if it didn’t adopt a .08% BAC level BY October 2003. Ohio adopted .08% BAC EFFECTIVE July 1, 2003.

The law was ALREADY in effect in 41 other states at that time. State Legislators estimated at least 30 lives would be saved due to the new law.

AT THE PRESENT TIME OHIO LAW STATES:
A person who has operated a motor vehicle, motorcycle, watercraft, snowmobile, locomotive, or aircraft and causes a death to another or an unlawful termination of another's pregnancy while committing the offense of OVI will be, in addition, charged with Aggravated vehicular homicide. This is a 3rd degree Felony. It is a 2nd degree felony if the driver's license was under suspension.

I COULD NOT FIND ANYWHERE THAT STATES IN WRITING THAT:

You still will be convicted if UNDER the legal limit, but I KNOW this is TRUE, I worked as a barmaid for 7 years before entering the medical field. I have talked to MORE THAN ONE PERSON that this has happened to after having a drink at dinner and then getting pulled over on the way home. (In one instance, the BAC did not even register but the woman admitted she had consumed a glass of wine at dinner.)

Either way, if you drink, JUST DON'T DRIVE, and everything WILL BE OKAY!

There are multiple websites that have it in writing but you have to research it closeley because they don't exactly put it in bold letters because the state and alcohol agencies are afraid of the impact it could have on tax revenue and sales. I am doing a report for my college english class. I have also done approximately 50 surveys and only 3 out 50 knew the law existed. To anyone who doubts it just call their local police station or court house. I called 6 police departments and 4 courts. All the courts confirmed it, but 4 out of 6 of the police departments him-hawed on it. I personally recieved an OVI in December...my first and last. I had to atten the 72 hour Alcohol weekend. There were 9 people the who's blood alcohol was below .08 but were charged twith the OVI.And we also found out that if you stop drinking alcohol and start drinking carbonated pop it...the carbonation from pop (not in beer for some reason) cause the absorbtion of the alcohol to speed up and go in to your blood quicker.Yes I agree cars and alcohol just don't go together. A statistic you didn't mention was that last year in Ohio alone there were 26,000 OVI's and there 11,000 deaths that were alcohol related...JUST last year. Staggering numbers for the MOST preventable charge. To anyone who has a plan when they are going out..have a back up plan. I put myself in a situation that should have never been. Butterflykisses the answer to your question is easy. Multiply just the minimum fine of $350.00 times 26,000 OVI's and see how much just the courts made on Dui's last year. Then multiple 26,000 times a $4

Then multiply 26,000 times a $425.00 reinstatement fee..that's how much the BMV makes. An to all the red bull/beer drinkers..your chances of getting an OVI are 67% greater than a beer or wine drinker. The caffeine makes you feel alive and "sober" which in turn gets you the high tier OVI with double fines and double jail time...the government has released this information yet does nothing to make awareness.
