WASHINGTON (AP) - The Supreme Court on Monday turned down a plea by environmental groups to rein in the Bush administration's power to waive laws and regulations to speed construction of a fence along the U.S.-Mexican border.

Homeland Security Secretary Michael Chertoff has used authority given to him by Congress in 2005 to ignore environmental and other laws and regulations to move forward with hundreds of miles of fencing in Arizona, California, New Mexico and Texas.

The case rejected by the court involved a two-mile section of fence in the San Pedro Riparian National Conservation Area near Naco, Ariz. The section has since been built.

As of June, 13, 331 miles of fencing have been constructed in California, Arizona, New Mexico and Texas.

"I am
extremely disappointed in the court's decision," Rep. Bennie Thompson, D-Miss., said. "This waiver will only prolong the department from addressing the real issue: their lack of a comprehensive border security plan."

Thompson chairs the House Homeland Security Committee. He and 13 other House democrats - including six other committee chairs - filed a brief in support of the environmentalists' appeal.

Russ Knock, a spokesman for the Homeland Security Department, said, "The American people expect this department to enforce the rule of law at the border. He added that the department is happy with the court's decision.

"As fence construction proceeds," Knocke said, "the department will continue to be a good steward of the environment, and consult with appropriate state, local, and tribal officials."

The concept of a border fence took on new life after the Sept. 11, 2001 terrorist attacks, which revived the heated immigration debate. Intelligence officials have said the holes along the southwest border could provide places for terrorists to enter the country.

Congress failed to pass comprehensive immigration reform when it had the chance in 2007.

Thompson said, "Without a comprehensive plan, this fence is just another quick fix."

Earlier this year, Chertoff waived more than 30 laws and regulations in an effort to finish building 670 miles of fence along the southwest border. Administration officials have said that invoking the legal waivers - which Congress authorized in 1996 and 2005 laws - will cut through bureaucratic red tape and sidestep environmental laws that currently stand in the way of fence construction.

Environmentalists have said the fence puts already endangered species such as two types of wild cats - the ocelot and the jaguarundi - in even more danger. The fence would prevent them from swimming across the Rio Grande to mate.

that last picture IS funny, but sadly it's true.

it was a blatant & pathetic attempt to pull at the heart strings of people over embryonic stem cell research. which, by the way has NOW been proven to work just as well with adult stem cells.

michael j fox has ruined ALL his credibility with this........and i believe he was in bed with michael moore. that in itself will ruin anyone's credibility.

Well, I do not believe it was a blatant and pathetic attempt on Micheal's part. I believe it was heartfelt and showed his concern for his disease, and the toll it has taken on his young life. Ruined his credibility?! NOT IN MY BOOK...... If anything, I respect him even more.

girlyscout, yes limbaugh has credibility problems, i don't take him very seriously unless i can independently confirm his assertions with proof.

we are so different it's scary GS. i didn't see the michael j fox thing as anything BUT manipulation and you saw it as brave. LOL how is it we are friends? lol

PB, you're kidding right? okay, limbaugh is not a nice person, he's mean, yada yada i'll give you that!

but MJF? please.........he USED the effects of his disease to scare & inflame people. if he was like that ALL the time that would be different, but he isn't, only when it's CONVENIENT for him. yes, his disease is terrible, but him USING the disease in such a sleazy way just was sick.

Sorry - I have seen Michael on many talk shows and he shakes ALL THE TIME! He actually makes me nervous watching him. Do you seriously think he uses his horrible symptoms of Parkinson's Disease for political points? My father-in-law had Parkinson's and I can tell you that the shaking is not controllable only when one wants it to be!

no gs, i don't know anyone with it. but there are meds that can control it........if not totally, then mostly.

that's my problem with this.....i have seen him many times as well. not lately, but back then when this happened. he was able to control it during guest appearances (probably through his meds) at the time, but then for this "dog & pony show" he wasn't? that's what i find to hypocritcal (spell?)

and yes, i DO believe he would forego his meds to make a political point. one that would potentially benefit him or others with this disease.

but, at this point, it's a foregone conclusion that embryonic stem cell is unecessary (spell?) and NOT an issue anymore. adult stem cells are working now.

Parkinson's meds are fickle. Sometimes they work. Sometimes they don't. Believe me, when my father-in-law had a bad day because his meds weren't working good that day, it was not a pretty sight.
And he may have been able to control it back when he was first diagnosed, but not so much now. Parkinson's gets progressively worse as years go by.
Volunteer at a Nursing Home and watch a Parkinson's patient in action. Then you will see.
Let's play "devil's advocate" and say he purposely didn't take his meds to make a point for a cure for Parkinson's. I WOULD DO THE SAME THING! Just like I donate and walk in the Breast Cancer Run every year because I have 2 sisters-in-law who are Breast Cancer survivors. Just like some actress (I forget her name), who promotes every cause for research on Autism, because her son has autism.
Just like Mother's Against Drunk Driver's testify before Congress on Drunk Driving because a child of theirs was killed by a drunk driver.
So even IF he did it on purpose - I STILL like him!!

I am 70 yrs. old and I have never seen our country in such dire straits as it is today. I was born in W.Va., Grew up in Pa. with Bobby Vinton, and ended up in Oh. Back then, when you graduated from high school in W.Va.,Pa.,or Ky., you received a diploma and a road map to Ohio. I grew up in the 50`s and 60`s, so I know what really good times in our` country were. GOD BLESS AMERICA AGAIN !
