The smoking ban need to be appealed!!!!!!!! We are expecting smokers to pay for the arts and build sport arenas  Clubs and restaurants should be in charge to decide to allow smoking in their businesses or not state government.

I agree that this smoking ban needs to be appealed. The reasons why I think it needs to be appealed is because the rules and laws have changed so much it is not what people voted on. People who voted yes gave the government the right to do whatever they wanted because there were no actual laws or rules in place on election day.

I absolutly agree with you rmarkle, like I've said before, it won't be long before any of us are unable to make our own decisions, they'll be made for us... the people that vote for issues like these don't seem to look at the picture later on down the road. What rights will any of us have?

Why did Ohio passed a bill into law with no clear guidelines in the first place how this smoking ban. I think someone appeal on the next ballot to repeal this.

Laws can not be "appealed". They CAN be "REPEALED", which would call for signatures to be gathered to get the issue back on the ballot and have the people vote on it again.

The smoking law wasn't a court decision, thus there is no appeals process available. Feel free to gather signatures and try to get it put back on the ballot. You can find out what the procedure is on the internet.

Thanks for clarifying that for me. I'm so upset that I wasn't watching what I was writing. I'm not a smoker, but there are too many laws on the books that conflict each other. We passed an arts bill last year to fund the arts in Cleveland and the same time we want to stop smokers from going to places that their money help fund them. I believe businesses should have the right to decide to go smoke free or not. If a business owner want to smoke free so be it. Smokers and Non-smokers have rights to patron places to smoke or not to smoke

the bottom line: we voted for this. this IS what the people (including me) wanted.

i am finding than many people who are complaining did not vote...live and learn.

when i was a kid, i remember standing in line at the supermarket behind smokers. we got used to the idea that you can't smoke inside stores...i think we can get used to the idea that we cannot smoke in other public buildings as well. people have a stronger right to good health. this right outweighs your right to pursue happiness.

your right to swing your arm ends where my nose begins.

i applaud the ban.

as for smokers paying for arenas and stadiums...part of me says that smokers shouldn't be singled out to pay for sports...since non smokers enjoy the sports too.

however, smokers take away tax money so they should give a little back.

how do they take away tax money? because most smokers (including the "environmentalist smoker") throw their butts on the ground. the city pays people to go around and pick this litter up. the butts that never get picked up look ugly...it's litter. so, the way i see it, smokers need to pay for something since they take money away from the system and they also make my world look ugly with litter.

the irony of this litter thing is that it is indeed litter, but if you go to the courthouse downtown and hang out outside for awhile, you will see law enforcement people throwing their butts on the ground too. heck, i even saw a judge do it once.

Smokers who are tired of "paying for the (building name here)", there is a simple way to stop paying for those buildings. Stop buying the product that is taxed.

Is there ONE positive reason to smoke? Just ONE.

And try to answer without using the word "rights" or "legal".

Just one.

The benefits to your heart? Your lungs? The increased life span? The cleaner smell of your drapes, furniture and everything in your house? Your hair? Your clothes?

Just one.

Smoking ban will NEVER be repealed because smokers are too weak to work toword getting the appeal on the ballot. If they had a strong will power to make something happen like that they would have the will power to quit. Every time i have had this discussion with a smoker they always say, usually in a low tone, that they would like to quit but can't. if this opinion makes you mad punish me by not smoking the rest of today, if you can't do that than, well, i rest my case.

LETS BAN FAST FOOD. It makes people fat and causes more health problems then smoking or alcohol. obese people have more heart trouble, high blood pressure, sugar,cancer,prostate trouble and other health problems and cost the insurance companies billions. It kills more people in this country than all other ills put together. including Wars. Oh and how about the people that wear so much purfume that you can taste it when they walk by. Lets ban GUNS, fast cars, sharp sticks too. Lets get em all so the rest of us can be happy.

I believe it won't be repealed because the tide has turned and there are more non smokers than smokers now. And unless the non smokers change their mind and vote in favor of allowing smoking, there just aren't enough numbers there. What you have here is a concentrated group of bar-goers being quite vocal about this. This is not a good representation of all the people in Ohio. I would venture a guess that MANY smokers voted in favor of the ban, just not those who patronize bars as frequently as others.

And like most states, this will die out in a few months. The smokers will learn to go outside like they have to do at work. There will be outdoor patios added on to some of the bars, and it will go away quietly. People in general are steadfastly opposed to change in the beginning. All the vitriol about rights and how nobody can tell YOU what to do and all of that will go away. The facts are that people tell you what to do every day of your life. Your boss, your wife(as I am well aware), your local police, the tax man.....

Not getting it to the ballot does not mean smokers are too weak to work at it. Perhaps the understanding of how futile that would be is more the key. And As far as smokers saying they can't quit, that is a crutch. The mind is the most powerful muscle in the body. You can do anything you want to do with a little mental toughness. I went from a daily 2 case of beer habit to zero in one day. You could do the same with nicotine. You do not defeat an addicition by feeding it. You defeat an addiction by starving it. Well, coyote, there was legislature on the table to cut the trans fat from food. People complained because they were being told what to do. Fast food chains are under scrutiny to turn out a healthier product.

So which way do you want it? DO you want healthier fast food or your "right" to eat what you want?

coyotedave: ban fast food? is this a good analogy? smoking is banned because it harms innocent bystanders..nobody really cares if a smoker kills her/mimself...all the hubbub is about thrusting bad things unto others.


i fail to see how anyone harms someone else by eating a big mac. sure, eating this is a health risk...but only to the eater, not to someone standing next to him.

bigtedparma - your argument that smoker's don't have the willpower to quit smoking, therefore they are also too weak to work to change the law is ludicrous! What scientific study is this based on? I think you just made that up. Until you get proof of this stop making such asinine statements!
